TSN 1290’s ULTIMATE CANADIAN LIVE SPORTS TOUR OFFICIAL RULES AND REGULATIONS

 

1. To enter TSN 1290’s ‘Ultimate Canadian Live Sports Tour’ contest (the “Contest”), a cue-to-call will be made (3) three times each weekday of the Contest Period (one each at approximately 7:15AM CST, 12:15PM CST, and 5:15PM CST, Monday to Friday), telling listeners to call in for a chance to win (the “Announcements”). When listeners hear these Announcements, they will be told to call the TSN 1290 contest line at 204-780-1290 (the “Contest Line”). In the event that the entrant is outside of the local calling area, standard long distance rates as charged by the entrant’s long distance service provider will apply. Correct callers or randomly selected text message qualifiers following these Announcements will be eligible for entry into the Prize Draw, as described below (an “Eligible Draw Entrant”). Each Eligible Draw Entrant will be announced on-air and may be required to chat on-air. If there is not a clear telephone connection between the TSN 1290 on-air announcer and an Eligible Draw Entrant, such that one or each other cannot hear the other, such Eligible Draw Entrant will be disqualified, and the Contest Sponsor will not be liable in any way for such failed connection. Each Eligible Draw Entrant will then be required to provide a representative of TSN 1290 with his/her name, address and telephone number. In conducting the contest, TSN 1290 and its representatives have the full and absolute discretion to disqualify any Eligible Draw Entrant who fails to respond on the phone or whose response cannot be heard, and the Contest Sponsor shall have no liability or responsibility to any Eligible Draw Entrant so disqualified. The odds of becoming an Eligible Draw Entrant will depend on the total number of individuals calling the Contest Line following the applicable Announcement. One (1) bonus qualifier will also be awarded once per weekday during the Contest Period at approximately 8:15AM CST. To enter, simply visit the website located at tsn1290.ca (the “Contest Website”), click on the Contest page, complete and submit your entry by following the instructions found on the Contest page. Fill out the entry email template with your first name, last name, home (mailing address), email address, ten digit daytime and evening telephone number and date of birth – along with one preferred destination city and one sport of interest. Entries will be rejected if entry is not fully completed and submitted during the Contest Period. In the event of a dispute with respect to entries submitted online, such entries shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries must include first and last name, address, email address, age, ten digit daytime and evening telephone number.


2. The Contest starts at 7:15 AM CST on Monday, February 27th, 2017 and closes on Friday, April 21st, 2017 (the “Contest Period”). There are four (4) grand prizes (the "Prizes") to be won. No purchase necessary. Void where prohibited. Limit of one Prize per household.


3. The contest sponsors and prize suppliers are: TSN 1290, a division of Bell Media Inc. (hereinafter referred to as the “Contest Sponsor”)


4. To enter and to be eligible to win, entrant must be a legal resident of Manitoba, Canada and be of the age of eighteen (18) at the time of entry or qualification. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize suppliers, and promotional and advertising agencies and administrators, are ineligible to enter. A winner of a previous Bell Media Inc. contest within 30 days preceding the start of this Contest (including persons designated by such winners to take ownership of prizes) and persons domiciled with a winner are not eligible to enter.


5. Prizes - There are four (4) Prizes, each consisting of one (1) trip for two (2) adults to any major Canadian city, up to a maximum value of $3,000 CAD. Trip(s) include: return economy airfare from Winnipeg to a Canadian destination of a winner’s choice, overnight accommodations in Canadian destination city, and 2 tickets to a 2017/2018 sporting event in Canadian destination city as selected by Contest Sponsor. Approximate retail value of the trip(s) is $3,000.00 CDN (excluding taxes). Actual retail value may vary depending on departure dates and times. Travel dates TBD based on winner availability and 2017/2018 preferred sport schedules. Travel must be booked no later than December 31, 2018. The winner and his/her travel guests must each have a proof of valid travel documents prior to ticketing, including a Canadian passport valid for at least 6 months. The winner and his/her travel guests must be Canadian residents to qualify for the Prize. The winner and his/her travel guests must not have past criminal charges or offenses. A minimum of one person, either the Grand Prize winner or one of the travel guests, must hold a valid credit card to cover any incidentals or any other requirement that may be required at the hotels. Ground transfers to and from the winner and/or travelling guest’s residence and designated airport and all other expenses not specified herein or listed within the travel brochure, including but not limited to telephone or fax, gratuities, optional tours, taxes and fees, insurance, medical travel documents, personal expenses, and any other costs not specifically stated herein as being included, are the sole responsibility of the winner and his/her guests. In the eventuality that the Winner and his/her guests reside in a city that requires transportation to the departure city, the costs associated with such transportation are the Winner’s and his/her guests entire responsibility. No extensions will be permitted and the prize cannot be exchanged, transferred or substituted for cash. The Grand Prize winner shall not be entitled to receive, in cash, certificate or otherwise, the balance of any amount representing the
difference of the Grand Prize retail value and actual cost. No frequent flyer miles will be available.


7) Each Prize winner and his/her travelling companion are solely responsible for all costs not expressly described herein, including, without limitation, as applicable, fuel/currency surcharges, meals and beverages, room service, gratuities, merchandise, telephone calls, insurance (medical, baggage or cancellation), departure taxes, items of a personal nature, any required travel documentation, all personal expenses of any kind or nature, and any overnight layover. Departure dates and accommodation are subject to availability and based on space available at time of booking and must be requested no later than 5 days prior to departure date – subject to change without notice or compensation. Each Prize winner and his/her travelling companion are also solely responsible for all costs incurred to and from the Departure Point as the Prize originate and terminate there. It is the sole responsibility of each Prize winner and his/her travelling companion to obtain all necessary travel documentation including valid Canadian passports and visas, and to comply with any customs and immigration requirements, as applicable. Each Prize winner and his/her travelling companion must be able to travel at the times and dates as determined by the Contest Sponsor, in its sole discretion and authority, failing which the Prize will be forfeited. It is recommended that each Prize winner and his/her travelling companion obtain sufficient personal insurance prior to departure. Travel Dates are determined by the Contest Sponsor at its sole discretion, and are subject to availability and to flight schedule. No changes to travel dates, names or destinations will be accepted. Travelling companion must be 18 years of age in order to participate in the Prize. In the event that a Prize winner resides within a 200 km radius of Winnipeg, the Prize is deemed not to include return airfare, and no cash will be provided in lieu thereof. No change in travel arrangements can be made by a Prize winner once his/her booking has been confirmed.


8) Each Prize may not be used towards any type of frequent flyer mileage, or other reward point accumulation program. Before being awarded a Prize, the travelling companion, will be required to sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form in the Contest Sponsor’s form stating, among other things, that he/she has read and understood these official rules and regulations (“Rules”), grants all consents required by the Contest Sponsor, authorizes the Contest Sponsor to broadcast, publish, disseminate and/or otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice and all other indicia of personality, in connection with any promotion and/or publicity, and/or for general news and/or for entertainment and/or information purposes at no additional compensation, beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsor and Prize Suppliers from any and all liability of any kind arising out of the travelling companion’s participation in this Contest and receipt and/or use of the Prize.


9) Prize(s) must be accepted as awarded. The Prize(s) may not be sold, transferred and are not convertible to cash. Contest Sponsor reserves the right to substitute a Prize in whole or in part in the event that all or any component of the Prize is unavailable. Prize winner is solely responsible for all costs not expressly described herein.


10) On select Mondays throughout and following the contesting period, March 13, March 27, April 10 and April 24, at approximately 7:00AM CST, a random draw for the Prize(s) will take place at Bell Media Inc., Winnipeg, Manitoba from among all Eligible Draw Entrants (the “Prize Draw”). The first Eligible Draw Entrant drawn will be eligible to win the Prize. The odds of winning a Prize from among the Eligible Draw Entrants are 1 in 160. Bell Media Inc., acting reasonably, will attempt to contact potential Prize winners to notify potential winners that they may have won a Prize by telephone within two (2) business days after the Prize Draw. In the event that a potential winner cannot be contacted within 2 business days after the Prize Draw, he or she will be disqualified and an alternate potential winner may be drawn at the Contest Sponsor’s sole discretion. Proof of identification must be provided upon request. In order to be declared a winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Bell Media Inc. Before being awarded a Prize, potential winner, will be required to sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form in the Contest Sponsor’s form stating, among other things, that he/she has read and understood these official rules and regulations (“Rules”), grants all consents required by the Contest Sponsor, authorizes the Contest Sponsor to broadcast, publish, disseminate and/or otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice and all other indicia of personality, in connection with any promotion and/or publicity, and/or for general news and/or for entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsor from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and/or use of the Prize. In the event that a potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify the potential winner, and draw an alternate potential winner, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner, shall be applied, with the necessary amendments, until a qualified winner has been duly selected, but in any event, no later than (3) three business days from the draw date.


11) By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.


12) All entries become property of Contest Sponsor who assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, mail, voice messages. No correspondence will be entered into except with entrants requesting Rules by mail or requesting the names of the Prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest, and select a winner from previously received eligible entries. Contest Sponsor reserves its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest website.


13) Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Contest. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Bell Media Inc.'s Privacy Policy, which is available at Bellmedia.ca/about/Media_Privacy.page. Any inquiry concerning the personal information held by the Contest Sponsor should be addressed to Bell Media Inc. at 1445 Pembina Highway, Winnipeg, Manitoba, R3T 5C2.


14) In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.


15) All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
