Rule 46.2 states:

“The aggressor in an altercation shall be the player who continues to throw punches in an attempt to inflict punishment on his opponent who is in a defenseless position or who is an unwilling combatant.”

The incident occurred late in the third period of the Sharks 3-0 victory over the Oilers, when Nurse engaged Polak in a fight as he was leaving the ice on a line change.

Both players were given fighting majors on the play and Nurse also received an extra roughing minor penalty.
