1. The TSN 1050 TEXT IN THE ANSWER TO WIN contest (the “Contest”) is being conducted by TSN RADIO 1050, a division of Bell Media Inc. (hereinafter referred to as the “Contest Organizer”).  A copy of these official rules and regulations (the “Rules”) are available at http://www.tsn.ca/radio/toronto-1050.

 

ELIGIBILITY

 

  1. To enter and to be eligible to win, entrant must be a legal resident of Ontario and be eighteen (18) years of age or older. Notwithstanding the preceding, the Contest is not open to individuals associated with the Contest, including the employees, agents and representatives of the Contest Organizer (including its divisions, subsidiaries, affiliates and agencies), its advertising and promotional agencies, prize fulfillment companies including Acxsys Corporation and The Marco Corporation, that provide materials and services related to this Contest or any other party directly linked to the holding of this Contest (the “Excluded Individuals”). This Contest is also not open to the immediate family members of the Excluded Individuals. For the purpose of these Contest Rules, “immediate family” includes: father, mother, brothers, sisters, children, legal or common-law spouse and individuals with whom such employees, agents and representatives reside. 

 

HOW TO ENTER

 

3.   No purchase necessary.  The Contest runs from March 16th, 2015 at 9:00 a.m. Eastern Time (“ET”) to March 20th at 12:00 p.m. ET (the “Contest Period”). Every weekday during the Contest Period a trivia question (each, a “Daily Trivia Question”) will be announced on TSN RADIO 1050 between approximately 9:00am - 12:00pm ET (each, an “Announcement”). When you hear an Announcement,  text the keyword “TRIVIA” to short code 105050  along with the answer to the Daily Trivia Question.  You must have access to a cellular telephone that is capable of two-way text messaging.  Text messaging is not available in all areas.  Standard text messaging fees apply (check your carrier plan for your standard text messaging fees).  Limit of one entry per individual per Daily Trivia Question during the Contest Period. If it is discovered that you attempted to enter more than the foregoing entry limit, all your entries will be void.  Entries shall be deemed to be submitted by the Authorized Mobile Account Holder of the mobile phone used to enter the Contest.  “Authorized Mobile Account Holder" of a mobile phone is defined as the natural person who is assigned to a cellular telephone number by a wireless carrier that is responsible for assigning cellular telephone numbers.  An eligible Prize (as described below) winner may be required to provide proof that he/she the Authorized Mobile Account Holder associated with the selected entry.

 

The first entry received after each Announcement will be eligible to win a Prize (described below). The Contest Organizer, acting reasonably, will attempt to contact each potential Prize winner to notify potential winner that he or she may have won a Prize using the telephone number provided at the time of entry within (2) business days after the applicable Announcement. In the event that a potential winner cannot be contacted within 2 business days after the applicable Announcement, he or she will be disqualified and an alternate potential winner may be drawn at the Contest Administrator’s sole discretion. Proof of identification must be provided upon request. In order to be declared a winner, each potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Bell Media Inc.

 

 

 

PRIZE DESCRIPTION

 

  1. The following Prizes are available to be won: 5 Prizes will be offered, each consisting of $150 CAD cash that will be awarded via an Interac e-Transfer®, which is a convenient way of electronically sending and receiving money directly from one bank account to another (“Prize”).

 

  1. The following conditions apply to each Prize: the winners must give their email address to the Contest Organizer and authorize the Contest Organizer to communicate their email address to the Prize fulfillment companies, The Marco Corporation (the “Prize Supplier”) and Acxsys Corporation. In order to access funds quickly, all potential winners must have access to online or mobile banking, an email address and a valid and active bank account in Canada.

 

6.   Prizes are subject to any financial institution fees that may be administered and shall be assumed by the winners.

 

WINNERS SELECTION

 

  1. The winners will be selected as described in section 3 of these Contest Rules.

 

  1. There is a limit of one (1) Prize per person per household.

 

9.   The odds of winning a Prize will depend upon the number of entries received in compliance with section 3 above following the applicable Announcement.

 

HOW TO CLAIM A PRIZE

 

10. In order to be declared a winner, each selected potential winner must be in compliance with these Contest Rules and in particular, the following:

 

  1. Answer correctly the mathematical skill-testing question as set out in section 3 above.

 

  1. The potential winner must sign the publicity release and liability waiver form (the “Release Form”) sent by the Contest Organizer and return it to them within three (3) business days of receipt.

 

11. By entering the Contest, each entrant agrees to abide by these Contest Rules. In the event a potential or declared winner fails to comply with any one of the conditions set out above or any other conditions set out in these Contest Rules, the Contest Organizer reserves the right to disqualify the potential winner, the winner will forfeit the Prize and the Contest Organizer shall be fully and completely released and discharged from any liability or responsibility in this regard and the Contest Organizer reserves the right to withdraw the Prize entirely with no further obligation to award such Prize to any additional potential winner.

 

12. Within three (3) business days following receipt of his/her duly completed and signed Release Form, the Contest Organizer will inform the confirmed winner on how to take possession of their Prize. The Prize portion of the Prizes will be sent by the Prize Supplier to winners’ bank accounts via Acxsys Corporation’s Interac e-Transfer. Prizes must be accepted in the Interac e-Transfer format in which the Prize Supplier is administering the Prize and cannot be redeemed for cash given via another process. Prizes may only be redeemed through the winners’ financial institution and is subject to any financial institution fees which may be administered. The Prize Supplier will send an email notification (from Contests@TheMarcoCorporation.com) to each winner upon receipt of their information. It will include links to participating financial institutions and explain the process for accepting an Interac e-Transfer as well as including the question/answer needed for the transaction to go through. Winner must select his/her financial institution to redeem the Prize by depositing the Interac e-Transfer into his/her bank account via secure online banking channels. Winner shall have a maximum of thirty (30) days to accept the Interac e-Transfer and deposit the Prize into his/her bank account, after which time the Interac e-Transfer will become null and void and the Prize will be forfeited. An Interac e-Transfer is a convenient way of sending and receiving money directly from one bank account to another. As mentioned before, in order to access funds quickly, one must have access to online banking, an email address, and a valid and active bank account in Canada and have a Canadian bank. Any winner who does not bank online with one of the  participating financial institutions will still be able to receive the Prize via Interac e-Transfer, by collecting his/her Interac e-Transfer in accordance with the conditions for offline Interac e-Transfers and as set out at http://www.interac.ca/consumers/faqs.php. If your financial institution does not yet offer the service, or if you don't bank online, you can still deposit transfers to any Canadian bank account. This option is available when you click the link in the notice you get when receiving an Interac e-Transfer. If you cannot click on the link, either cut and paste or type the link into your browser. You will be required to register and provide your banking information in order for the Prize to be deposited into your bank account. The deposit usually takes 4 - 6 business days to process. If you are unable to claim your Prize via an Interac e-Transfer or an “offline” Interac e-Transfer, the Prize Supplier will courier you a cheque. The Prize Supplier will require the Prize amount, the winner’s name and a delivery address.

 

In the event a winner fails to collect his or her Prize in accordance with the instructions set out in this paragraph, the winner will forfeit the right to collect the Prize, and the Contest Organizer reserves the right to withdraw the Prize entirely, with no further obligation to award such Prize to a new winner.

 

GENERAL CONDITIONS

 

13. Verification. Any entrant that does not have an email address and a valid and active bank account in Canada, or who does not correctly answer the mathematical skill-testing question asked on the Release Form or otherwise does not comply with these Contest Rules will automatically be rendered invalid and will not be entitled to be eligible for a Prize.

 

14. Disqualification. The Contest Organizer reserves the right to disqualify any person or cancel one or more entries of any person participating in this Contest or trying to participate by means contrary to these Contest Rules or in a manner which is unfair to other entrants. Any attempt to tamper with the entry process, interfere with these Contest Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, is a violation of criminal and civil laws and the Contest Organizer reserves the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future contests. Such person may be referred to the appropriate judicial authorities.

 

15. Non compliance/eligibility. If a potential or declared winner is not in compliance with these Contest Rules, the Contest Organizer reserves the right to disqualify the winner, the winner will forfeit the Prize and the Contest Organizer shall be fully and completely released and discharged from any liability or responsibility in this regard and the Contest Organizer reserves the right to withdraw the Prize entirely with no further obligation to award such Prize in any additional draws.  Any potential or declared winner, who is not in compliance with these Contest Rules, must so inform the Contest Organizer immediately upon being contacted by the Contest Organizer.

 

16. Acceptance of Prize. Prizes must be accepted as described in these Contest Rules and may not be transferred to another person or substituted for another prize, subject to the section below.

 

17.       Substitution of Prize. In the event it is impossible, difficult and/or more costly for the Contest Organizer to award a Prize (or part of a Prize) as described in these Contest Rules, the Contest Organizer reserves the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the Prize (or of the part of the Prize) in cash.

 

18.       Refusal of a Prize. The refusal by a potential or declared winner to accept any Prize awarded in accordance with the Contest Rules, releases and forever discharges the Contest Organizer, its agents, The Prize Supplier, and Acxsys Corporation of all obligations related to the  Prize, including delivery.

 

19.       Liability limit – use of prize. Each entrant and any potential or declared winner releases the Contest Organizer, its subsidiaries, divisions, parent corporation, its advertising and promotional agencies, the Prize Supplier and Acxsys Corporation, their shareholders, members (if any), officers, directors, employees, agents and representatives (the “Beneficiaries”) from any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the Contest or the acceptance or use/misuse of his/her Prize or any portion thereof. In order to be declared a winner and prior to obtaining his/her Prize, any potential or declared winner agrees to sign a declaration to such effect in the Release Form.

 

20. Liability of Prize Supplier. Any person selected for a Prize acknowledges that upon communication by the Contest Organizer confirming the winning of the Prize, all services to be rendered in connection with their Prize become the sole responsibility of Acxsys Corporation and the Prize Supplier. A declaration to such effect will be included in the Release Form.

 

21.       Liability limit – running of the Contest. The Beneficiaries are not liable for faulty computer components, software, or links; the loss or non-existence of communications capability; or faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult, or render a user unable, to enter the Contest; problems with any website or website feature howsoever caused, the malfunction of, or damage caused to, any telephone or network or lines, computer equipment, data or software, online systems, servers or access providers; or the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer “hackers”. The Beneficiaries are not liable for any harm contestants may suffer directly or indirectly as a result of downloading any Web page or software or transmitting any information related to entry in the Contest.

 

22.       Modification. The Contest Organizer reserves its right to cancel, terminate, modify or suspend this Contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Contest Rules. 

 

23.       Early termination of the Contest. In the event that participation in the Contest must be terminated in whole or in part before the closing date of the Contest as per the Contest Rules, only the winners already selected in accordance with section 3 of these Contest Rules as of the date of termination of the Contest will win a Prize. The Contest Organizer will have no obligation to give the remaining number of Prizes.

 

24.       Limit of Prizes. In no event shall the Beneficiaries be obligated to award more prizes than set out in these Contest Rules or to award prizes otherwise than in compliance with these Contest Rules.

 

25.                               Impossibility to act – labour dispute. The Beneficiaries shall not be responsible for any damages for a failure to operate the Contest in accordance with these Contest Rules in any case where their incapacity to act results from circumstances or a situation beyond their reasonable control or because of a strike, lock-out or any other labour dispute in their company or those of businesses which services are used for holding this Contest, war, riot, insurrection, earthquake, terrorism, civil commotion, fire, flood, accident, storm or any other act of nature.

 

26.       Liability limit – participation. Any person who participates or tries to participate in this Contest releases the Beneficiaries from any and all liability for damages which he/she could suffer from participating or trying to participate in this Contest.

 

27.       Authorization. By entering this Contest, each declared winner consents to the Contest Organizer, Prize Supplier and Acxsys Corporation and their representatives’ use, at their sole discretion and if required, their name, photograph, likeness, testimonial related to a Prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant. A declaration to such effect will be included in the Release Form.

 

28.       Communication with entrants. No communication (other than while registering) or correspondence will be exchanged with entrants in the context of this Contest, with the exception of selected entrants or declared winners.

 

29.       Personal information. Entrant personal information that is collected in this Contest will be used solely by the Contest Organizer and Prize Supplier and Acxsys Corporation and their representatives for the administration of the Contest. There will be no communication of commercial or of any other nature, unrelated to this Contest sent to an entrant, unless such entrant gives specific authorization to the Contest Organizer for that specific purpose.

 

30.       Decisions of the Contest Organizer. All decisions of the Contest Organizer or those of its representatives regarding this Contest are final and binding.

 

31. Identification of the entrant. For the purposes of these Contest Rules, the entrant is the person whose entry was the first to be received after the applicable Announcement as set out in section 3 above. It is to this person that the Prize will be awarded if selected and declared a winner.

 

32. Unenforceability. If a section of these Contest Rules is declared or ruled by a Court of Law as illegal, unenforceable or void, that section will be deemed void but all other sections not affected will be enforced as allowed by law.

 

33. Jurisdiction. This Contest is subject to all applicable federal, provincial and municipal laws.
