Philadelphia Flyers defenceman Radko Gudas has waived his right to an in-person hearing for boarding Boston Bruins forward Austin Czarnik on Saturday night, the NHL's department of player safety announced.

Gudas will now have a phone hearing on Monday and can be suspended more than five games.

The 26-year-old was assesed a minor penalty for the hit, which was late and contacted Czarnik in the head. Gudas was ejected earlier in the preseason for a hit on New York Rangers rookie Jimmy Vesey.

Gudas scored five goals and added nine assists last season. He is considered a repeat offender.
